Identification and Regulation of Repeated Prosecution in Civil Litigation

In 2015, China Supreme People’s Court for the first time issued a judicial interpretation on civil procedure. order to address persistent problem of repeated prosecution parties abusing their litigation rights in proceedings, court makes provision prosecutions, so that it can be followed during trials. Undeniably, this has filled gaps law, but there are still some problems its application. At present, Article 247 The Judicial Interpretation Civil Procedure Law stipulates standard should “two same” or “three same.” However, if only formal review is conducted, system will discredited, and subject substantive review, may lead inconsistent decisions different places; therefore, disadvantageous authority understanding application basic action. view this, necessary us examine whether constitutes prosecution.
